County Clerk Duties

The County Clerk has several important duties. The County Clerk is an elected position is is the custodian for many public records, like deeds. The office functions as a big part of the local election process by increasing voter registration and is also the recorder of deeds. The County Clerk also issues marriage licenses.

District Court

There are thirteen different judicial districts in New Mexico, with Bernalillo County being the 2nd District. District courts are courts of general jurisdiction and hold jury trials. District court hears civil,criminal, and family court cases.

Municipal Court

Municipal Courts are courts of limited jurisdiction and do not have jury trials. There are 80 municipal courts in New Mexico. Cases heard before municipal courts are punishable by a maximum of 179 days in jail per offenses. Petty misdemeanors, DUIs, traffic violations, and violations of municipal ordinances are heard in Municipal Court.

Bernalillo County Metropolitan Court is a limited jurisdiction court that combines and performs the functions of the Albuquerque Municipal Court, Bernalillo County Magistrate Court, and Bernalillo County Small Claims Court.

The other municipal court in the county is Los Ranchos (Bernalillo County).

Civil Court

In New Mexico, Civil Courts hear cases involving non-criminal actions. For example, personal property damage, malpractice, name changes, and probate are common cases that are heard in this type of court. There is a Civil Clerk’s Office, which processes case documents and verifies case information and court hearings.

Criminal Court

Criminal Court handles all felony criminal cases, requests for search warrants, and appeals of Bernalillo County Metropolitan Court decisions. There is a Criminal Clerk’s Office, which processes case documents and verifies case information and court hearings. This office also receives monies for fines, restitution, and bonds.

Family Court

Cases that are heard in Family Court usually involve dissolution of marriage, parentage, adoption, guardianship, custody and visitation, domestic violence, and child support.

Cases include divorce, parentage, custody and visitation, child support, domestic violence, adult adoption, and kinship guardianship.

Probate Court

Probate Court hears cases involving the will and/or the estate of a deceased person. It also has jurisdiction over trusts, estates of minors or incapacitated persons, and involuntary commitments for mental health and/or drug treatment. Probate Court is also in charge of issuing marriage licenses.

Children’s Court

Children’s Court handles nearly all cases related to juveniles. This includes adoption, cases of child abuse and neglect, emancipation, authorization for marriage, and juvenile delinquency. This court also hears cases regarding mental health commitments for both adults and children.

Drug Court – Treatment Court

Drug Court is a court-supervised program that offers an alternative to incarceration for non-violent offenders. There are programs for both adults and juveniles who have committed drug-related crimes or non-drug crimes that are related to drug use. This is an intensive outpatient program.

Veterans Court

Bernalillo County Metropolitan Community Veterans Court addresses substance abuse and behavioral health disorders for veterans who have been charged with misdemeanor. Offenders are not eligible if they’ve been convicted of a violent offense or a sexual offense.
